1 Acceptance of Terms

By registering for an account, accessing, or utilizing the SWSWA Multi device version web portal, REST APIs, multi-device WhatsApp gateway connectivity, and automated messaging tools (collectively referred to as the "Service"), you agree to be bound by these Terms and Conditions ("Terms").

If you are accepting these Terms on behalf of a company, organization, or other legal entity, you represent and warrant that you possess full authority to bind that entity to these conditions.

2 Service Description & Gateway

SWSWA Multi device version provides a cloud-based communication suite that empowers businesses and developers to connect WhatsApp instances, transmit transactional alerts, dispatch automated replies, trigger marketing templates, and integrate via REST API endpoints.

Independent Platform Notice: SWSWA Multi device version is an independent automation tool and is not officially affiliated with, endorsed by, or sponsored by WhatsApp LLC or Meta Platforms, Inc.

3 Accounts & API Security

To use our services, you must provide accurate, complete, and current registration information. You are solely responsible for:

  • Maintaining the confidentiality of your username, password, two-factor authentication (2FA) credentials, and Personal API Keys.
  • All actions, messages, and webhook requests initiated through your API tokens or connected WhatsApp device instances.
  • Promptly notifying SWSWA Multi device version if you discover any unauthorized access or compromise of your credentials.

4 Acceptable Use & Anti-Spam Policy

You agree to utilize the Service strictly for lawful commercial or personal communications in full compliance with local telecommunications laws and WhatsApp's Terms of Service.

Strictly Prohibited Activities:
  • Sending unsolicited bulk commercial messages (spam), phishing attempts, scams, or fraudulent promotions.
  • Harassing, threatening, defaming, or distributing content that infringes upon any third-party intellectual property or privacy rights.
  • Purchasing unverified contact lists and broadcasting messages to recipients who have not explicitly opted in.
  • Bypassing WhatsApp rate limits, reverse engineering, or exploiting platform vulnerabilities.

Violation of this Anti-Spam Policy will result in immediate device disconnection and permanent account termination without prior notice or refund.

5 Subscription Plans & Razorpay Payments

We offer subscription tiers billed in Indian Rupees (INR) including Starter (₹ 199/month), Pro (₹ 499/month), and Enterprise (₹ 999/month).

  • Payment Processing: All transactions are securely processed via Razorpay. We do not store raw debit/credit card numbers or UPI PINs on our servers.
  • Billing Cycles: Subscriptions are billed in advance on a recurring monthly or specified validity cycle.
  • Feature Quotas: Device allowances, monthly message limits, auto-replies, and REST API access correspond to your active plan level.

6 Intellectual Property Rights

All software code, graphics, documentation, user interface designs, logos, and system architecture comprising SWSWA Multi device version are the exclusive intellectual property of the platform operators and protected under international copyright and intellectual property laws.

7 Disclaimers & Limitation of Liability

The Service is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind. While we maintain 99.9% gateway uptime, we cannot guarantee uninterrupted service due to upstream WhatsApp/Meta protocol updates, mobile network latency, or device disconnection by phone carriers.

In no event shall SWSWA Multi device version be liable for indirect, punitive, incidental, or consequential damages resulting from message delivery delays, WhatsApp number bans initiated by Meta algorithms, or unauthorized account access.

8 Termination & Suspension

You may cancel your subscription at any time directly through your account dashboard. SWSWA Multi device version reserves the right to suspend or terminate accounts that breach these Terms, fail to pay invoices, or generate high recipient abuse reports.

9 Governing Law & Jurisdiction

These Terms and any dispute arising out of or related to our Service shall be governed by and construed in accordance with the laws of India, without regard to conflict of law principles. Any legal proceeding shall be subject to the exclusive jurisdiction of the competent courts.
